K.N.Baswa Raj v. Dr.A.Ashok,
THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE P.KESHAVA RAO C.C.No.2036 OF 2017 ORDER:
(Per Sanjay Kumar, J) This Contempt Case was instituted alleging willful disobedience to the order dated 04.08.2016 passed by the common High Court for the State of Telangana and the State of Andhra Pradesh in W.P.No.813 of 2010. By the said order, the authorities were directed to act upon the orders passed by the Andhra Pradesh Administrative Tribunal, Hyderabad, in a batch of OAs.
The learned Government Pleader for Services-I, State of Telangana, would inform this Court that the order has been duly complied with and the Commissioner of Intermediate Education, State of Telangana, Hyderabad, issued proceedings dated 12.3.2018 imposing upon the petitioner the lesser punishment of withholding two annual grade increments with cumulative effect. A copy of the said proceedings is placed on record. In the light of this development, we are of the opinion that no further orders need be passed in this Contempt Case. If the petitioner is aggrieved by the proceedings dated 12.3.2018 issued by the Commissioner of Intermediate Education, State of Telangana, Hyderabad, he would necessarily have to take remedial measures independently and the validity of the said proceedings cannot be looked into in exercise of contempt jurisdiction.
The Contempt Case is accordingly closed.
