SMT JUSTICE T.RAJANI CRIMINAL PETITON No.805 OF 2018 ORDER:

This petition is filed, under Sections 437 and 439 of the Criminal Procedure Code, 1973, seeking to enlarge the petitioner, who is A3, on bail in Crime No.349 of 2017, on the file of Chillakur Police Station, Sri Potti Sri Ramulu Nellore District, for the offences punishable under Sections 302, 379, 109 r/w 34 IPC.

Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.

As per the case of the prosecution A1 and A2 killed the deceased, who is the wife of A3. According to the case of the prosecution A3 had illicit intimacy with A1 and A2 is the mother of A1. The record reveals that A1 and A2 committed the murder of the deceased at the instigation of A3. 4.

Hence, in view of the above allegations, this court opines that this is not a fit case for granting anticipatory bail. 5.

Accordingly, the Criminal Petition is dismissed. As a sequel, miscellaneous petitions pending consideration, if any, in this case shall stand closed. _____________ T.RAJANI, J 23.01.2018 SS
