THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WP.Nos.37980 and 38019 of 2015 COMMON ORDER :

The petitioners in both these Writ Petitions claim to be owners of Acs.0.6 gts of land in Sy.No.99, Uppal Khalsa Village and Mandal, Rangareddy District.

2. Originally, the said property belonged to the husband of petitioner in WP.No.27980 of 2015, who is the father of petitioner in WP.No.38019 of 2015.

3. The petitioners contend that under a Gift Settlement Deed dt.11.03.2004, the husband of petitioner in WP.No.37980 of 2015 settled these properties in their favour and ceased to be owner thereof. They contend that the Indian Oil Corporation viz., (respondent nos.6 and 7 in both Writ Petitions) is running a Petrol Pump in the land which has been gifted to petitioners pursuant to a lease granted by husband of petitioner in WP.No.37980 of 2015 on 16.08.2004, which lease has expired. The petitioners further contend that respondent nos.2 and 3 are the competent authorities to grant licensees under the Explosives Act to the said Corporation, and that in view of the fact that the husband of petitioner in WP.No.37980 of 2015 is no longer the owner of the land, and since the petitioner objected to the renewal of the said licensees in favour of respondent nos.6 to 8 (who is the dealer running the petrol pump), the respondent nos.2 and 3 be directed not to renew or extend the explosive license for operating the said petrol pump.

4. Both the parties have submitted a detailed representation dt.22.04.2015 to the 2nd respondent, and they now seek a direction from this Court to respondent nos.2 and 3 to dispose of the same in accordance with law within a time specified.

5. Smt. A. Sarala, learned Standing Counsel for Central Government for respondent nos.2 and 3 in WP.No.37980 of 2015, and Sri A.V.S. Rama Krishna, learned counsel appearing for respondent nos.2 and 3 in WP.No.37980 of 2015, state that respondent nos.2 and 3 will consider and dispose of petitioner's representation within a period of one (01) month from the date of receipt of a copy of this order.

Having regard to the said submission, the Writ Petitions are disposed of directing respondent nos.2 and 3 in both the Writ Petitions to dispose of petitioner's representation dt.22.04.2015 not to extend explosive licenses to respondent nos.6 to 8 in both the Writ Petitions within a period of one (01) month from the date of receipt of a copy of this order in accordance with law, and communicate their decision to petitioners.

7. Accordingly, the Writ Petitions are disposed of with the above directions. No order as to costs.

8. As a sequel, miscellaneous petitions pending, if any, in these Writ Petitions shall stand closed.
