THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 2897 of 2019 O R D E R:

When the matter is taken up, it is submitted by the learned counsel for the petitioners that the issue raised in the present Writ Petition is squarely covered by the order, dated 11.02.2019, passed by this Court in Writ Petition Nos.9609 of 2016, 1719 of 2017, 838 and 1700 of 2019.

Relevant portion of the aforesaid order reads as under: "In those circumstances, the writ petitions are disposed of with a direction to the 5th respondent-Forest Divisional Officer in W.P.No.1719 of 2017, Tahsildar, Yellandu, Bhadradri Kothagudem District, Assistant Director Mines & Geology, to conduct a joint survey in the presence of the petitioner, within a period of four weeks from the date of receipt of a copy of this order, and determine whether the land falls under the Reserve Forest area. If the land falls under the Reserve Forest area, the petitioner shall work out his remedies under law, or seek alternative land for quarrying operations.

However, considering the assertion of the forest officials that the land in question falls under Reserve Forest areas, till such time a joint survey is conducted and the nature of land decided, the petitioner shall not carry out any quarrying operations in the subject land."

Following the aforesaid order and for the reasons stated therein, this Writ Petition is also disposed of in terms thereof. Miscellaneous petitions, if any, pending in this writ petition shall stand disposed of. There shall be no order as to costs. _________________________ CHALLA KODANDA RAM, J Dt:18.02.2019 kdl
