JUSTI CE ANI S WRI T PETI TI ON No.41891 of 2015 ORDER: (per Hon'ble Sri Justice Sanjay Kumar) This writ petition was filed assailing the e-auction sale notice dated 26.11.2015 issued by the Bank of India proposing to conduct the sale of the secured asset on 28.12.2015.

A conditional interim order of stay was granted by this Court on 23.12.2015 in relation to the scheduled sale. This order was however not complied with.

It is now represented that the auction sale scheduled to be held on 28.12.2015 did not materialise for want of bidders. That being so, challenge to the e-auction sale notice dated 26.11.2015 is rendered purely academic and does not warrant consideration on merits.

The writ petition is accordingly dismissed on this short ground. The petitioner is at liberty to invoke appropriate remedies in accordance with law as and when a fresh cause of action arises. All issues are left open. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
