THE HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.35713 OF 2016 ORDER:

This Writ Petition is filed seeking to declare the action of respondents in not promoting the petitioners to higher posts from the category of MPDO, even after 17 years of service, because of nonfinalisation of seniority list of MPDOs', as illegal and arbitrary.

2. Sri S. Satyam Reddy, learned Senior Counsel for the petitioners, submits that though both the petitioners were appointed in the year 1999 as Mandal Parishad Development Officers, they have not earned even one promotion and with great difficulty, respondent No.2 issued provisional seniority list on 20.08.2016 calling for objections. He further submits that since it takes a long time to finalise the seniority list, the respondents can consider the case of the petitioners for ad hoc promotion, as has been done in the case of other departments.

3. On the other hand, learned Government Pleader for Services submits that unless seniority list is finalised, no promotion can be given, but if the petitioners submit a representation for consideration of their case for ad hoc promotion, necessary action will be taken.

4. In view of the same and since, it is submitted by the learned Senior Counsel for petitioners that the petitioners will make necessary representation for grant of ad hoc promotion till finalisation of the

seniority list, it is open to the petitioners to make a representation to respondent No.2 to consider their case for ad hoc promotion. On filing such representation, respondent No.2 shall dispose of the same within a period of six (6) weeks in accordance with law and take action accordingly, since it is stated that the petitioners, though working from 1999, have not earned even one promotion.

5. With the above direction, the Writ Petition is disposed of. Miscellaneous Petitions, if any, pending in this Writ Petition, shall stand closed. There shall be no order as to costs. ___________________________ A. RAJASHEKER REDDY, J October 24, 2016.
