This writ petition is filed seeking to declare the action of the respondents 2 to 8 in threatening to dispossess the petitioners by demolishing the structures constructed in the land admeasuring 28 sq. yards belonging to the 1st petitioner, the structures constructed in the land admeasuring 120 sq. yards belonging to the 2nd petitioner and the structures constructed in the land admeasuring 32 sq. yards belonging to the 3rd petitioner situated at Sy.No.1168, Aswaraopet village and mandal, Badradri-Kothagudem district under the grab of road widening, without issuing any notice and without recourse to law as being illegal, arbitrary and consequently direct the respondents not to interfere with the peaceful possession and enjoyment of the petitioners' shop in question. 2.
Heard the learned counsel for the petitioners and the learned Asst. Government Pleader for Roads and Buildings. Learned Asst. Government Pleader for Roads & Buildings, on instructions, submits that the R & B authorities and the staff of the concerned Grampanchayat have identified the encroachments on the road margin and marked the affected structures on both sides of the road, the shops/structures belonging to the petitioners are not being affected as they are situated beyond the right of way of 50 feet from the centre and there is no attempt made to demolish them.
Inasmuch as it is stated that the shops/structures of the petitioners are not being demolished, recording the said submission made by the learned Asst. Government Pleader, the
