HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 10569 of 2017 ORDER:

The grievance of the petitioner in the Writ Petition is that though she seized to operate oil extraction business with effect from 2010-2011, during which period the tax demanded was Rs.6,500/-, respondents, all of sudden, now demanded tax of Rs.2,28,711/- from the period 2010 to 2017 without there being any notice and without there being proper assessment.

Heard Sri N.Praveen Kumar, learned Standing Counsel for respondent - Municipality.

Considering the nature of controversy in issue, and as the petitioner had already filed objections on 20.03.2017, the Writ Petition is disposed of with a direction to respondent No.2 to consider the objections of the petitioner, make proper assessment and, thereby, fix property tax liability, taking into consideration the assertion of the petitioner that she was not running oil mill from 2010 to 2017 onwards; and, restraint order has since been issued, there shall be stay of all further proceedings till the disposal of the objections of the petitioner by respondent No.2 subject to the condition of petitioner depositing a sum of Rs.50,000/- (Rupees Fifty Thousand Only) to the credit

of respondent No.2 within a period of two weeks from today.

Miscellaneous petitions pending, if any, shall stand dismissed. No order as to costs.
