This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.5 in Crime No.333 of 2023 on the file of Station House Officer, Narsampet Police Station, Warangal District, registered for the offences punishable under Sections 8(c) read with 20(b)(ii)(B) of NDPS Act-1985.

Heard learned counsel for the petitioner/Accused No.5 and learned Assistant Public Prosecutor for the respondentState. Perused the record. 3.

Learned counsel for the petitioner submitted that the petitioner/Accused No.5 was arrested on 04.01.2024 and he was in judicial custody since then, no contraband was seized from the possession of petitioner/Accused No.5. The accused Nos.1 and 2, who were the co-accused from whom 1.5 kgs of dry ganja was seized, were released on bail on 27.09.2023 by

this Court and prayed to grant regular bail to the petitioner on the same conditions as incorporated against the accused Nos.1 and 2.

Learned Additional Public Prosecutor submitted that there were no criminal antecedents against the petitioner herein.

As such considering that no contraband was seized from the possession of the petitioner/accused No.5 and he was in judicial custody since 04.01.2024, this Court deems it appropriate to enlarge the petitioner on regular bail on certain conditions 6.

Accordingly, the Criminal Petition is allowed and the petitioner shall be released on regular bail subject to the following conditions:

i) The petitioner/Accused No.5 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five thousand only) with two sureties for a like sum each to the satisfaction of the learned Special Sessions Judge for NDPS cases (I Additional Sessions Judge) Warangal.

ii) The petitioner/Accused No.5 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. 7.

Miscellaneous applications, pending if any, shall stand closed.
