THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.33285 of 2015 ORDER:
The grievance of the petitioner was that the police authorities were not closing Crime No.580 of 2015, which was registered upon his complaint to the Malkajgiri Police Station, Cyberabad, Ranga Reddy District.
It is the case of the petitioner that after registration of the afore-stated crime, the matter has been settled but the police authorities were not recording his statement under Section 161 Cr.P.C. and closing the FIR.
The Sub-Inspector of Police, Malkajgiri Police Station, Cyberabad, furnished written instructions dated 03.11.2015 to the Office of the learned Government Pleader for Home stating that the petitioner never approached the police authorities to record his fresh statement under Section 161 Cr.P.C. and that necessary action would be taken in the matter if he approached them. In the light of the afore-stated facts, the Writ Petition is disposed of leaving it open to the petitioner to approach the police authorities concerned for the purpose of recording his fresh statement under Section 161 Cr.P.C. In the event the petitioner furnishes such a statement, the police authorities shall take appropriate action thereon in accordance with law.
Pending miscellaneous petitions shall stand closed in the light of this final order. No order as to costs.
