HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.3055 of 2019 ORDER:

The prayer of the petitioner in this case reads as under: "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in failing to issue Pattadar Passbooks to the Petitioner and others, who are the absolute and lawful owners of the property admeasuring Acs.19.29 guntas in Sy.No.135 situated at Vattinagulapally Village, Rajendranagar Mandal (Old), presently Gandipet Mandal, Ranga Reddy District, notwithstanding the representations dated 26.02.2018 and 28.09.

2018 given by Petitioner and others as illegal, arbitrary, unjust and also against the provisions of The Telangana Rights in Land and Pattadar Pass Books Act, 1971, and consequently direct the Respondents to issue Pattadar Passbooks to the Petitioner and others, who are the lawful owners with respect to the said property and to pass such other order or orders as this Honourable Court may deem fit and proper in the facts and circumstances of the case."

The petitioner claims to have submitted an application in the prescribed format for mutation and issuance of pattadar passbooks in relation to the subject land as per the provisions of the Telangana Rights in Land and Pattadar Pass Books Act, 1971. The Writ Petition is accordingly disposed of directing the Tahsildar, Gandipet Mandal, Ranga Reddy District, to verify as to whether the petitioner has submitted an application in Form VI(A) for mutation and consequential action, and in the event such an application has been made along with the requisite fee, the Tahsildar, shall take appropriate action thereon expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this order.
