THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 6427 OF 2011 O R D E R:

When the matter is taken up for hearing, learned counsel for the petitioner as well as the learned standing counsel, appearing for the 3rd respondent, submitted that the similar issue was considered by this Court in W.P.No.14805 of 2010, and the said order was also confirmed by the Division Bench of this Court in W.A.No.738 of 2012, dated 21.06.2012. In those circumstances, learned counsel for the petitioner prays that the present writ petition also may be disposed of in terms of the said order.

Recording the said submission the Writ Petition is disposed of on the following terms:

1) As undertaken by the petitioners, they shall not interfere with the laying and maintaining of the pipeline to the extent of 30 meter width;

2) The petitioners shall not indulge in any act, which is likely to damage the pipeline;

3) The petitioners shall not sell any part of the land of 30 meter width, which is being utilised for laying the pipeline and its maintenance for the present and also in future, if such need arises or encumber the same in any manner to the third parties; and

4) In case of any violation is there, the respondent authorities shall be at liberty to demolish the same.

Consequently, the Miscellaneous Applications, if any shall stand closed. No costs.
