THE HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.17833 of 2015 ORDER:

Heard the learned counsel for petitioner and the learned Government Pleader for Civil Supplies for respondents.

2. The petitioner was appointed as a fair price shop dealer of shop No.17 of Nandipadu Village, Kolimigundla Mandal, Kurnool District and his authorization is in force. While so, a report was submitted by the fourth respondent on 25.03.2015, based on which, the authorization of the petitioner was suspended, by order dated 30.04.2015. Challenging the same, the present Writ Petition is filed.

3. The impugned order shows that the petitioner committed the following irregularities.

"1. The F.P. Shop dealer is not distributing the Sugar since 5 years except March 2015 and selling ECs higher rates instead of fixed by the Government and contravened the provisions of Law under clause 7(1) of the A.P.S.P.D.S. (Control) Order, 2008.

2. That the F.P.Shop dealer has not maintained stock register and contravened the provision of Law under condition of 3 of the APSPDS (Licensing, storage and Regulation) Order, 2008.

3. That the F.P.Shop dealer has not residing in the village.

4. The F.P.Shop dealer has not exhibited the stock cum price list board in the shop and contravened the provisions of law under clause 22(vii) of the A.P. State Public Distribution System (Control) Order, 2008."

4. In view of the said irregularities, this Court is not inclined to interfere with the enquiry process at this stage. 5.

In the circumstances, the Writ Petition is disposed of directing the third respondent to conduct an enquiry and complete

the same by observing the principles of natural justice within a period of 30 days from the date of receipt of a copy of this order. No order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
