HON'BLE SRI JUSTICE R. KANTHA RAO WRIT PETITION NO.27758 OF 2015 ORDER:
Heard the leaned counsel appearing for the petitioner and the learned Counsel appearing for the respondents.
2. The petitioner who is the Field Assistant was removed from service after conducting enquiry on certain allegations levelled against him. The impugned order terminating the petitioner from service was passed on 28.10.2013. The petitioner preferred an appeal to the second respondent on 14.07.2015. According to the petitioner, the order of removal was not served on him at appropriate time and therefore, he filed the appeal on 14.07.2015.
3. It is submitted by the learned counsel appearing for the petitioner that the appellate authority has not passed any orders in the appeal filed by the petitioner and the respondents are contemplating to appoint some other person as Field Assistant in the vacancy arose out of termination of the petitioner.
4. Under the aforementioned circumstances, without going into merits of the case, the writ petition is disposed of directing the second respondentCommissioner, Rural Development of A.P., Hyderabad/Appellate Authority to dispose of the appeal submitted by the petitioner within a period of four weeks from the date of receipt of a copy of this order. There shall be no order as to costs. Miscellaneous petitions, if any, filed in this writ petition shall stand closed.
