THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.2389 of 2018 ORDER:

In this Writ Petition, petitioner challenges the notification, dated 20.01.2018 issued for appointment of dealers for newly created fair price shops mainly on the ground that on an earlier occasion, the petitioner along with other dealers had approached this Court by filing Writ Petition No.6396 of 2014 questioning the bifurcation of fair price shops and the notification issued for appointment of dealers for newly created fair price shops wherein stay has been granted, as such, the respondents cannot proceed with further inasmuch as the very proposed action in terms of G.O.Ms.No.35, dated 17.09.2007 came to be stayed by this Court. The petitioner asserts that he has not been given an opportunity of hearing and proposed action is only at the instance of a local MLA.

Heard learned counsel for the petitioner and learned Government Pleader for Civil Supplies appearing for the respondents.

At the outset, it is to be noted that today, in Writ Petition No.6396 of 2014, this Court dealt with an identical issue and

CKR, J W.P.No.2389 of 2018 considered the validity of various contentions of the petitioners therein and dismissed the same. The reasoning given by this Court in the said order squarely applies to the case on hand. In those circumstances, there is no merit in the Writ Petition, which is accordingly dismissed.

Miscellaneous Petitions, if any pending shall stand closed. There shall be no order as to costs.
