This petition is filed seeking for quash of the proceedings in C.C.No.846 of 2010 on the file of the Court of the XIII Additional Chief Metropolitan Magistrate, Hyderabad. 2.
Heard the counsel for the petitioners and the Public Prosecutor, who took notice for the 2nd respondent.
The 1st respondent has not appeared in spite of issuance of notice.

The counsel for the petitioner took this court through the allegations made in the complaint. A perusal of the complaint would show that absolutely there are no allegations made against these petitioners. At one place, it is mentioned that she lived with her in-laws, which included the 5th accused. The complaint shows that the complainant mentioned the names of the persons against whom she made allegations of harassment, but the names of these accused do not find place among the said persons. Hence, in the absence of any allegations in the report, it can be said that no offence is made out against the petitioners. On the face value of the complaint itself, it can be said that there are no allegations that would constitute the alleged offences against the other accused. Hence, I deem that this is a case where the further proceedings in the case would result in abuse of process of law. Hence, the
further proceedings in C.C.No.846 of 2010 against these petitioners are quashed.

With the above observations, the Criminal Petition is allowed and the proceedings in C.C.No.846 of 2010 are hereby quashed. As a sequel, the miscellaneous applications, if any pending, shall stand closed.
