HONOURABLE SRI JUSTICE U.DURGA PRASAD RAO C.R.P. No.458 of 2018 ORDER:

Heard learned counsel for petitioners and this C.R.P is disposed of at the admission stage as this Court finds no reason to order notice to the respondents. 2) This CRP is filed by the petitioners/defendants aggrieved by the order dated 19.12.2017 in O.S.No.1 of 2010 on the file of Junior Civil Judge, Wanaparthy, whereunder the learned Judge rejected the objection raised by the learned counsel for defendants that a copy of Pahani was also issued to defendants which is similar to Ex.A15 cannot be considered at that stage. 3) Upon hearing learned counsel for petitioners, it is understood that according to the petitioners/defendants, for the same year i.e, 2009-2010 another pahani was issued showing the names of the defendants but in Ex.A.

15 which was said to be issued to the plaintiffs for the same year, curiously, the names of defendants are not found and hence it is not a genuine document. It should be mentioned that the Trial Court rightly observed that the said objection cannot be considered at the stage of marking of Ex.A.15. Therefore, the petitioners' right to challenge the veracity of Ex.A.15 is well preserved and at the appropriate time the petitioners can question the veracity of Ex.A.15 and the Trial Court shall pass a reasoned order on merits in respect of such objection. With this observation, this Civil Revision Petition is disposed of. As a sequel, miscellaneous petitions if any pending, shall stand closed. _________________________ U.
