ORDER
This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioners, who are arrayed as accused Nos.1 to 8 in Crime No.249 of 2025 before the
Kuravi Police Station, Mahabubabad, registered for the offences punishable under Sections 189(2), 191(2), 329(3), 126(2), 118(1), 115(2), 119(1), 351(2) read with 190 of BNS. 2.
The brief facts of the case are that on 31.10.2025 at Gundrathimadugu Station, Kuravi Mandal, complainant Tajunoth Sulochana and her son Raghuveer were laying the foundation for their house with government permission when they were stopped and threatened by Battu Rajini and Rathnavath Parvathi. The next day, 01.11.2025, they were again obstructed, their sand tractor was sent away, and Battu Krishna, Parvathi, and Rathruvath Shreesha threatened to kill them. Later that day, petitioner Nos.5 to 8 allegedly assaulted the complainant and her son with sticks, causing bleeding injuries, and attempted to snatch a gold chain from her neck. Basing on the same, the crime was registered for the above said offences.

Heard Sri B. Balaji, learned counsel appearing on behalf of the petitioners as well as Sri D. Arun Kumar, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioners submitted that the petitioners are innocent of the alleged offences and that there are case and counter-cases filed by both parties arising out of land disputes between them. He submitted that a partition suit vide O.S.No.179 of 2025 is pending before the Principal Junior Civil Judge-cum-Judicial Magistrate of First Class, Mahabubabad, and that, with a view to settle the land dispute, the petitioners were falsely implicated in the present case. Therefore, he prayed the Court to grant pre-arrest bail to the petitioners by allowing this Criminal Petition. 5.
On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioners contending that the Investigating Authority had already served notice under Section 35(3) of the BNSS on 28.11.2025 and, therefore, there is no question of granting anticipatory bail. Hence, he prayed the Court to dismiss the criminal petition.
6. In the light of the submissions made by both the learned counsel and upon a perusal of the material available on record, it appears that case and counter-cases have been filed
against each other and that a civil suit for partition of the properties is also pending between the parties. Further, although the learned Additional Public Prosecutor submitted that notice under Section 35(3) of the BNSS was already served, the offence under Section 191(2) of the BNS is punishable with imprisonment exceeding seven years.
Considering the facts and circumstances of the case, this Court deems it fit to grant pre-arrest bail to the petitioners, subject to the following conditions:
i.
The petitioners shall surrender before the Station House Officer, Kuravi Police Station, Mahabubabad District, within two weeks from today, and on such surrender, the said Station House Officer shall release them on bail on executing a personal bond for Rs.25,000/-, each with two sureties, for the like sum each.
ii.
The petitioners shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.
iii.
The petitioners shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., for a period of eight (8) weeks or till the filing of the charge sheet, whichever is earlier and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
