ORDER

Heard learned counsel on either side.

The petitioner is a Field Assistant. Based on the social audit report alleging certain irregularities, charge sheet was issued to him and explanation was called for. Thereafter, enquiry was held against him and vide impugner order dated nil-05-2015 he was removed him from service.

Learned counsel appearing for the petitioner submits that in the course of enquiry, the grounds stated in the explanation and the certificates and other documents submitted by the petitioner have not at all been considered by the Enquiry Officer and therefore, the order impugned is liable to be set aside.

On the other hand, learned Special Counsel appearing for the respondents would submit that since the petitioner preferred an appeal to the 2nd respondent and the same is pending, a direction can be issued to dispose of the appeal within a reasonable time.

Considering the submissions made by the learned counsel on either side, the Writ Petition is disposed of directing the 2nd respondent to dispose of the appeal filed by the petitioner within a period of eight weeks from the date of receipt of a copy of this order duly considering the contentions in the explanation and taking into consideration all the documents furnished along with the explanation by the petitioner. No costs.

Miscellaneous Petitions, if any, pending shall stand closed.
