HONOURABLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 19134 of 2015.

ORDER:

Heard learned Counsel for the petitioner and learned Government Pleader for the respondents.

The petitioner was appointed as a Fair Price Shop Dealer for Benikal Village, Kanekal Mandal, Ananthapur District in the year 1985 on permanent basis. While so, on the basis of the report submitted by the Tahsildar on 20.4.2015, the authorization of the petitioner was suspended by order dated 15.5.2015 mainly on the ground that there are variations in the quantities of rice, Atta and kerosene oil. Challenging the said

order, the present Writ Petition is filed.

The learned Counsel for the petitioner submits that the charges framed against the petitioner are trivial in nature and therefore the fourth respondent ought not to have suspended the authorization of the petitioner based on the said charges. Having perused the impugned order, this Court is not inclined to set aside the same. However, liberty is given to the fourth respondent to conduct an enquiry and complete the same within a period of three months from the date of receipt of a copy of this order by duly following the principles of natural justice.

The Writ Petition is accordingly disposed of. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
