THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN And THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CONTEMPT CASE No.1684 of 2015 ORDER: (per Hon'ble Sri Justice Ramesh Ranganathan) The order, violation of which is alleged in the present Contempt Case, is the order passed in W.P.No.3783 of 2015 dated 02.03.2015. The said order required respondent Nos.1 to 3 to examine the matter, and pass a reasoned order on the claim of both the petitioner and the fourth respondent within three months from the date of receipt of a copy of the order. Both the petitioner and the fourth respondent were permitted to put forth their claims in writing to respondent Nos.1 to 3 within one month from the date of the order i.e. on or before 02.04.2015. The petitioner submitted her representation on 08.05.2015 enclosing thereto a copy of the order of this Court.

It is evident that the representation itself was submitted more than a month after the time stipulated by this Court. Be that as it may, the order of this Court required the respondents to comply with the order within three months from the date of receipt of a copy of the order i.e. on or before 08.08.2015. While initially, an order was passed on 08.09.2015, on noticing that the said order was not in compliance with the order of this Court, the respondents passed a revised order on 06.01.2016.

There has been a delay of five months in compliance. The second respondent has filed a counter-affidavit expressing his regret and has apologized for the delay in compliance. In view of the apology tendered by the second respondent, for the belated compliance of the order of this Court dated 02.03.2015, we see no reason to proceed against respondent Nos.1 to 3 under the Contempt of Courts Act, 1971. The Contempt Case is, accordingly, closed. Miscellaneous Petitions pending, if any, shall also stand disposed of. There shall be no order as to costs.
