THE HON'BLE SRI JUSTI CE P.KESHAVA RAO WRI T PETI TI ON No.2851 OF 2020 ORDER:

Heard the learned counsel appearing for the petitioner as well as the learned standing counsel appearing for respondents 2 and 3. 2.

The prayer sought in the writ petition is as under: 'For the reasons stated in the accompanying affidavit, it is prayed that this Hon'ble Court may be pleased to issue an order or direction in the nature of Writ of Mandamus directing the respondents to demolish all unauthorized and illegal constructions, including the platforms (Chabutars) and the encroachments made in the Nala's land and around H.No.13-2-258/B situated at Balaji Nagar, Rahimpura, Puranapool, Hyderabad 5000006 and pass such other order or orders as may be deemed just and necessary in the interest of justice.'

The main grievance of the petitioner is that some unauthorized constructions are coming up, including the platforms (Chabutars), in the Nala land and around H.No.13-2-258/B situated at Balaji Nagar, Rahimpura, Puranapool, Hyderabad.

Learned standing counsel placed on record the notice No.2581/TPS/GHMC/2020, dated 15.02.2020, issued by the 2nd respondent-Corporation.

From the perusal of the said notice, it is revealed that the Corporation has already taken steps for removal of the said illegal encroachments by issuing the above notice. It is also stated in the notice that the owner/occupier of the premises No.13-2-258/B is requested to furnish a copy of the ownership certificate along with the sanctioned plan/BRS plan copy, if any, for verification within three days from the date of receipt of the letter, failing which, further action shall be initiated as per the provisions of the Greater Hyderabad Municipal Corporation Act, 1955.

Since the Corporation has already issued the notice under reference, this Court is of the opinion that the grievance of the petitioner is already taken care of by respondents 2 and 3. Therefore, no further cause would survive in the writ petition.
