HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.2939 of 2019 ORDER:

This writ petition is filed seeking a Writ of Mandamus declaring the action of the 2nd respondent in not considering the case of the petitioner for appointment to the post of Librarian (Schools) in Residential Educational Institutions Society by duly verifying the certificates, as illegal and arbitrary and sought a consequential direction to the 2nd respondent to consider the case of the petitioner for appointment to the post of Librarian (Schools) by duly verifying her certificates on par with others, pursuant to Notification No.20 of 2017 dated 14.04.2017.

Heard Smt.K.Udaya Sri, learned counsel for petitioner and Sri D.Balakishan Rao, learned Standing Counsel for 2nd respondent. It has been contended by the petitioner that she is fully eligible and qualified to be appointed as Librarian and the respondents have issued Notification to fill up the post of Librarian on 14.04.2017. The petitioner has responded to the said Notification and after undergoing regular selections, she has secured best rank. Initially, the written examination results were announced and the petitioner was not called for verification of the certificates. Subsequently, the respondents vide Notification dated 23.07.2018 had called the petitioner for verification of the certificates.

At the relevant time, the petitioner has not noticed the said Notification issued by the respondents inviting the petitioner to participate in the certificates verification and the said information was received by the petitioner during October, 2018. Thereafter, the petitioner has submitted a representation on 03.11.

verification process and also consider her case for appointment to the post of Librarian, but the respondents have neither considered the said representation nor considered the case of the petitioner for appointment to the post of Librarian.

Learned counsel for petitioner contends that appropriate orders be passed directing the respondents to consider the case of the petitioner for appointment to the post of Librarian by duly taking into consideration the representation submitted by the petitioner on 03.11.2018.

Learned Standing Counsel for 2nd respondent has submitted that wide publicity was given through proceedings dated 23.07.2018 and individual messages were also sent to the candidates informing that the candidates should appear for certificates verification. In spite of giving wide publicity, the petitioner has not availed the opportunity, but, however, contends that the representation of the petitioner will be considered and appropriate orders would be passed.

This Court, having considered the rival submissions made by the parties, is of the considered view that the writ petition can be disposed of directing the respondents to consider the representation submitted by the petitioner on 03.11.2018 and pass appropriate orders in accordance with law within a period of four weeks from the date of receipt of a copy of this order. With the above observations, the writ petition is disposed of. No order as to costs.
