THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION Nos.2761, 2763, 2773, 2775, 2776, 2794, 2813 & COMMON ORDER:

These writ petitions are being disposed of at the admission stage with the consent of both parties.

In all these writ petitions, the grievance of the petitioners is that the respondents have rejected their nominations without assigning any reasons and without giving any opportunity to them. Counsel for the petitioners in these writ petitions had contended that as per the Telangana Co-operative Societies Rules, 1964, the respondents must assign reasons for rejecting, but the cases of the petitioners were rejected orally and that too without notifying the reasons as to why their cases were rejected. Therefore, counsel for the petitioners had contended that let the respondents receive their nominations for the present and verify them within two days before conducting elections, after giving opportunity to the petitioners, and if the petitioners could not satisfy about their stand, then it is always open for the respondents to eliminate them from participating in the election process.

Government Pleader appearing for the respondents had contended that the cases of the petitioners would be examined by the respondents after giving opportunity and the respondents would consider each of the petitioner's case and pass appropriate orders before conducting elections scheduled on 15.02.2020.

This Court, having considered the rival submissions of learned counsel for parties, is of the considered view that these writ petitions can be disposed of directing the respondents to accept the nominations, as today is the last date for finalizing the list of nominations. However, the respondents shall decide about the eligibility of the petitioners before conducting elections, after giving reasonable opportunity to the petitioners to defend their case.

With the above directions, these writ petitions are disposed of. No order as to costs.
