HON'BLE DR. JUSTICE B. SIVA SANKARA RAO Writ Petition No.31121 of 2017 ORDER:

Heard the learned counsel for the writ petitioner/accused in Cr.No.367 of 2017 dt.22.05.2017 registered for the offences punishable u/sec.167 and 170 IPC and also the learned Govt. Pleader representing the respondents 1 and 2 before ordering the notice to the 3rd respondent and perused the grounds urged in the quash petition and contents of the FIR.

Even taken on face value of the offences as if made out, both are punishable for three years and two years respectively. Having regard to the above and from substance in the allegations according to the contention of the learned Govt. Pleader, there is nothing to interdict the investigation however pending investigation, the petitioner shall not be arrested but this will not prevent securing of his presence for the purpose of investigation. All the available defences are left open. Accordingly and in the result, the Criminal Petition is disposed of. Consequently, miscellaneous petitions, if any shall stand closed.
