THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.2379 of 2018 ORDER:

Challenging the inaction of the respondents in considering the representation, dated 20.01.2018, of the petitioner, the present Writ Petition is filed.

2) It is the claim of the petitioner-company that it has entered into an agreement, dated 08.04.2013, with the 5th respondentRegional Manager, Secunderabad, for mopping and sweeping of buses at Ranigunj-II Depot, initially for a period of three years and thereafter it was extended for a further period of two years vide proceedings dated 01.04.2016 issued by the 1st respondent. Though in terms of the agreement, the petitioner rendered its services, only a part of the money was received from the respondent Corporation and the balance amount has not been paid in spite of representations dated 26.09.2017 and 15.12.2017. On account of which, the petitioner, being a Labour contractor, is suffering. In that context, the petitioner has made a representation, dated 20.01.2018, to the 1st respondent and seeks a direction to respondents to consider it's representation.

3) The innocuous prayer, which the petitioner seeks before the Court, is that the representation filed by it on 20.01.2018, pending before the 1st respondent, to be disposed of as expeditiously as possible.

4) Considering the prayer of the petitioner, without expressing any opinion about the rights of the parties, since a copy of the representation, dated 20.01.2018, is also submitted to the 5th respondent, he is directed to consider the said representation and pass appropriate orders within eight weeks from the date of receipt

of a copy of this Order. It is made clear, this Court is not expressing any opinion with respect to the claim of the petitioner. No costs. 5) Consequently, Miscellaneous Petitions pending, if any, shall also stand closed.
