HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.43031 of 2016 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking to declare the inaction of the 3rd respondent in disposing of the application in File No.L/7171/2012, as illegal and arbitrary.

Heard the learned counsel for the petitioner as well as the learned Assistant Government Pleader for Revenue for respondents. With their consent, the writ petition is disposed of at the stage of admission itself.

The limited grievance of the petitioner in this writ petition is that though he submitted an application on 19.03.2012 along with others in File No.L/7171/2012 before the Revenue Divisional Officer-cum-Inam Tribunal, Chevella Division, seeking to record their names as occupants and issue Occupancy Rights Certificate in respect of agricultural land admeasuring Ac.0-28 gts. in survey No.28 situated at Gachibowli Village, till date no orders are passed. Learned AGP would submit that the 3rd respondent may be directed to dispose of the application, if the same is still pending consideration, in accordance with law.

Having regard to the rival submissions made, the Writ Petition is disposed of directing the 3rd respondent-The Revenue Divisional Officer-cum-Inams Tribunal, Chevella Division, to deal with the representation made by the petitioner along with others on 19.03.2012 seeking to record their names as occupants and

issue Occupancy Rights Certificate in respect of agricultural land admeasuring Ac.0-28 gts. in survey No.28 situated at Gachibowli Village, and pass necessary orders thereon, in accordance with law, after hearing the petitioner and other aggrieved persons, if any, as early as possible, preferably within a period of eight weeks from the date of receipt of a copy of this order. Miscellaneous petitions pending in this writ petition, if any, shall stand closed. No order as to costs.
