HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.10950 of 2017 ORDER:

This writ petition is filed by the petitioner seeking the following relief:

"..... to issue Writ or direction more particularly in the nature of Writ of Mandamus declaring the action of the respondents 3 and 4 in trying to evict the petitioner from her house bearing Door No.7-129/1, Tadigadapa Village, Penamaluru Mandal, Krishna District, by demolishing the same as illegal, arbitrary, unconstitutional, violation of principles of natural justice and contrary to the Rules of Panchayat Raj Act, 1994 and also contrary to the Article 14, 21 and 300-A of Constitution of India and consequently direct the respondents not to demolish the petitioner's property bearing Door No.7-129/1, Tadigadapa Village, Penamaluru Mandal, Krishna District, without due process of law ....."

Heard learned counsel for the petitioner as well as the learned Government Pleader for Panchayat Raj and the learned Standing Counsel for 3rd respondent - Gram Panchayat.

When the matter is called, it is submitted by the learned Government Pleader for Panchayat Raj and also the learned Standing Counsel for 3rd respondent - Gram Panchayat that the respondents will follow due process of law while evicting the petitioner from the subject property.

Recording the said submission, without expressing any opinion on the merits of the matter, this writ petition is disposed of directing the respondents to follow due process of law, while evicting the petitioner from the subject property. 5.

As a sequel, Miscellaneous Petitions pending consideration, if any, in the Writ Petition shall stand closed. No order as to costs.
