Heard learned counsel for the petitioner and learned Government Pleader for the respondents.

2. The petitioner was appointed as a Fair Price Shop Dealer of Shop No.56 of Melavai Village, Madakasira Mandal, Anantapur District, by proceedings dated 28.07.2008. While so, the 2nd respondent issued a show cause notice on 04.02.2015 indicating three charges against the petitioner. The petitioner submitted his explanation on 09.02.2015. After receipt of the explanation, an order was passed by the 2nd respondent on 23.02.2015 cancelling the authorization issued in favour of the petitioner. Challenging the said order, the present writ petition is filed.

3. A counter affidavit is filed supporting the impugned order passed by the 2nd respondent. However, in view of the remedy of appeal that is available to the petitioner, this Court is disinclined to go into the merits of the case and the petitioner is given liberty to file an appeal to the competent authority within 15 days from the date of receipt of a copy of the order and the competent authority shall dispose of the appeal within a period of three months after receipt of the appeal, after giving a due opportunity to the petitioner to submit his case.

4. The Writ Petition is accordingly disposed of. Miscellaneous petitions, if any, pending in the writ petition shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 16th June, 2015
