HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.2913 of 2019 ORDER:

This writ petition is filed seeking the following relief :- " ..... to issue an order of direction more particularly one in the nature of Writ of MANDAMUS (a) declaring the action of the respondent authorities in not considering the petitioner's representation dated 13.12.2018 and not issuing posting orders allowing the petitioner to rejoin duty as Part Time Junior Lecturer Vocational (CT) in Civil Engineering Branch is illegal, arbitrary, contrary to Arts. 14, 16 and 21 of the Constitution of India and violative of Principles of Natural Justice and (b) consequently direct the respondent authorities to issue posting orders to the petitioner as Part Time Junior Lecturer Vocational (CT) in Civil Engineering Branch in Government Junior College (New) Malakpet or any other college in and around Hyderabad where vacancy exist ......" .

Heard Mr.K.Srinivasa Prasad, the learned counsel for petitioner and the learned Government Pleader for Services-I. It has been contended by the petitioner that he was appointed as a part time Lecturer in the 3rd respondent College during the year 1992. After completion of five years of service, the petitioner was extended minimum time scale of pay and he was discharging his duties to the satisfaction of everyone concerned. While so, during the year 2008, the petitioner has applied leave owing to certain domestic problems and other issues. Later on, the petitioner has made representations on 13.12.2018, 23.01.2019 and 01.02.2019 requesting the respondents to re-engage him as part time Lecturer in any of the existing vacancies in and around Hyderabad. But, so far, the respondents have not passed any orders

on the representations submitted by the petitioner nor re-engaged the petitioner as part-time Lecturer.

Learned counsel appearing for the petitioner submits that appropriate orders be passed in the writ petition directing the respondents to consider the representations submitted by the petitioner on 13.12.2018, 23.01.2019 and 01.02.2019 and pass appropriate orders in accordance with law.

Learned Government Pleader appearing for the respondents has contended that the petitioner was absconding from duties since 2008 and he was engaged only as a part time Lecturer. The case of the petitioner will be considered and appropriate orders would be passed on the representations submitted by the petitioner in accordance with law.

This Court, having considered the rival submissions, is of the considered view that this writ petition can be disposed of directing the respondents to consider the representations submitted by the petitioner on 13.12.2018, 23.01.2019 and 01.02.2019 and pass appropriate orders in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order. With the above observations, the writ petition is disposed of. No order as to costs.
