THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4223 OF 2016 ORDER:

This petition is filed by the petitioner-accused under Section 482 Cr.P.C. seeking to quash the proceedings against him in Crime No.51 of 2016 on the file of I-Town U/G Police Station, Kadapa City, YSR Kadapa District, registered for the offence punishable under Section 420 IPC.

Heard and perused the material available on record. It is alleged that the petitioner agreed to sell his land of an extent of Ac.0.38 cents to the de facto complaint at Rs.8,25,000/- per cent and after receiving advance of Rs.78,30,000/- and subsequently, he paid the entire amount, but the petitioner did not come forward to register the said land in the name of the de facto complainant. The truth or otherwise of the above said allegations can be ascertained during the enquiry. Therefore, this Court is not inclined to interfere with the investigation against the petitioner.

At this stage, the learned Counsel for the petitioner submitted that due to the pendency of the above crime, the petitioner apprehends arrest and harassment in the hands of the police. Considering the facts and circumstances of the case, this Court is inclined pass the following order:

The petitioner is directed to appear before the Station House Officer concerned on or before 07.04.2016 and execute a bond for a sum of Rs.10,00,000/- (Rupees ten lakhs only) with one surety for the like sum for his future appearance before the investigating officer concerned, for the purpose of investigation. With the above directions, the Criminal Petition is disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed.
