THE HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.6559 of 2016 PC: (per the Hon'ble The Acting Chief Justice Dilip B. Bhosale) Heard learned counsel for the parties.

There is no dispute that a revision lies under Rule 12 of the Taxation and Finance Rules framed under Section 130 of the Andhra Pradesh Municipalities Act, against the demand of property tax, as made in the present writ petition. In view thereof, learned counsel for the petitioner submits that the petitioner is prepared to file revision within a period of two weeks from today.

Mr. Md. Saleem, learned counsel for respondent No.2 submits that if the petitioner files revision as aforementioned within a period of two weeks from today, the concerned authority shall consider and decide the same on merits in accordance with law and without entering into an issue of limitation. He further submits that the revision will be considered and decided without demanding the tax as per the impugned notice. His statement is recorded and accepted. In view thereof, nothing further survives in the writ

petition.

Learned counsel for the petitioner prays for withdrawal of the writ petition with liberty to the petitioner to file revision under Rule 12 of the Taxation and Finance Rules. Writ Petition is disposed of as withdrawn with liberty as prayed.

Consequently, miscellaneous petitions, if any, also stand disposed of.
