THE HON'BLE SRI JUSTICE SANJAY KUMAR AND THE HON'BLE SRI JUSTICE M. SEETHARAMA MURTI WRIT PETITION No.28082 of 2016 ORDER: (Per Hon'ble Sri Justice Sanjay Kumar) The unsuccessful applicant in O.A.No.72 of 2016 on the file of the Andhra Pradesh Administrative Tribunal, Hyderabad, is before this Court aggrieved by the dismissal of his application by order dated 20.01.2016.

The only ground on which the petitioner/applicant was nonsuited was his failure to take recourse to the appellate remedy provided under Rule 33 of the Andhra Pradesh Civil Services (Classification, Control & Appeal) Rules, 1991. Though Sri P. Lakshmana Rao, learned counsel for the petitioner/applicant, would state that his client filed an appeal, we find that the document relied upon in this regard is only a handwritten Telugu letter with the caption 'Appeal'.

Learned Government Pleader would state that this is not the proper format for filing an appeal.

In that view of the matter, we are not inclined to interfere with the order passed by the Tribunal. It is for the petitioner/applicant to take recourse to appropriate remedies in accordance with law. In the event any appeal is filed by the petitioner/applicant, the same shall be considered on its own merits and in accordance with law expeditiously.

The writ petition is accordingly dismissed.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
