HONOURABLE JUSTICE G, SRI DEVI CRIMINAL PETITION No.1008 of 2020 ORDER:

The petitioner-A2 filed the present application under Sections 437 and 439 of the Code of Criminal Procedure, seeking to grant bail to him in Cr.No.6 of 2020 on the file of Karimnagar ll Town Police Station, Karimnagar District, registered for the offences under Sections 366, 417, 420 lPC.

The case of the prosecution is that on 14.06.2019 al afternoon, Al along with the other accused had forcibly kidnapped the de-facto complainant, namely, Bhukya ttilalathi, aged 2'l years, with an intention to marry her on the same day at 1700 hours at Nirmal and cohabited with her. However, she came to know that A1 was already married and he had children, thereby cheated her. 3.

Learned counsel for the petitioner/A2 submits that the petitioner/A2 is innocent of the alleged offence and he is no way concerned with the alleged kidnap and marriage of 41 with the defacto complainant. He further submits that the petitioner's name was implicated on the basis of his small acquaintance with 41 and in order to harass him. He further submits that the petitioner is a law abiding citizen having permanent abode and he is willing to furnish suitable security. He further submlts that the entire investigation is completed, except filing of the charge sheet and that the petitioner shall abide by any condition imposed by this Court 4.

Learned Additional Public Prosecutor opposed to grant bail to the petitioner/A2, but conceded to the fact that the entire allegations

GSD. J Crl.P.No.1008 of 2020 are levelled against 41 only and there are no specific allegations against the present petitioner.

Having regard to the facts and circumstances and in view of the nature of allegations levelled against the petitioner/A2, without adverting to the merits of the matter, I am inclined to grant bail to the petitioner/A2 on certain terms and conditions. 6.

The Criminal Petition is allowed and the petitioner/A2 shall be released on bail on the following terms and conditions: (i) That the petitioner/A2 shall execute a personal bond for a sum of Rs.15,0004(Rupees fifteen thousand only) with two sureties for a like sum each to the satisfaction of the Judicial First Class Magistrate, Karimnagar.

(ii) that the petitioner/A2 shall appear before the lnvestigating Officer on first Saturday of every month till completion of investigation or filing of charge sheet, whichever is earlier. (iii) Thereafter, the petitioner/A2 shall appear before the Court concerned personally on each date of hearing till conclusion of trial.

(iv) that the petitioner/A2 shall not indulge in any similar type of activities, in future;

(v) that the petitioner/A2 shall not tamper with the prosecution witnesses;

(vi) that the petitioner/A2 shall co-operate with the investigating agency.

(vii) that the petitioner/A2 shall not misuse the liberty granted to him.

As a sequel, miscellaneous applications, if any pending, shall stand closed.
