HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.19274 of 2015 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies. The Writ Petition is being disposed of at the stage of admission with the consent of parties. The petitioner was appointed as a fair price shop dealer of fair price shop No.29, Sankepally Village, Shankarpally Mandal, Ranga Reddy District. His authorization is valid upto 31.04.2015. While so, the Mandal Revenue Inspector inspected the village, verified the sales register of November, 2013 and conducted an enquiry. Based on the report of the Mandal Revenue Inspector, the third respondent, by the impugned proceedings 27.01.2015, cancelled the authorization of the petitioner. Challenging the said order of cancellation of authorization, the petitioner preferred an appeal to the second respondent on 04.02.

2015, along with a petition to suspend the said order. As no final orders are passed in the said appeal, the present Writ Petition is filed. Since the petitioner had already availed the remedy of appeal, which is pending for the last four months before the second respondent, this Court is not inclined to examine the case on the merits of the case.

In the circumstances, the Writ Petition is disposed of directing the second respondent to conduct an enquiry, in the appeal preferred by the second respondent, after giving due opportunity to the petitioner, and dispose of the appeal within a period of thirty days from the date of receipt of a copy of this order.

Miscellaneous petitions, if any, pending in this writ petition shall stand disposed of. No order as to costs.
