THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.2887 of 2019 ORDER :

The petitioner in this Writ Petition is a saw mill, represented by its Proprietor. It asserts that initially it was run with one Vertical Saw only. Later, with the permission of the fourth respondent, one Horizontal Log Saw was installed and subsequently it was also permitted to install one additional number of Vertical Saw. Accordingly, it was run with two Vertical Saws and one Horizontal Saw. Its licence was renewed till 31.03.2019. The petitioner alleges that at the time of renewal of licence, the fourth respondent unilaterally deleted inclusion of one Vertical Saw and Horizontal Saw each without any notice. Challenging the same, the present Writ Petition is filed. Heard the learned counsel for the petitioner.

Learned Government Pleader for Forests submits that on account of the orders of the Supreme Court, now the Rules have been amended and notified vide G.O.Ms.No.55, Environment, Forests, Science and Technology (For.I) Department, dated 26.09.2016, under which a State Level Committee was also constituted under G.O.Rt.No.203, dated 16.12.2016, which has been empowered to consider the applications made in prescribed format for granting licences, either fresh, or for installation of additional machinery, and as on date, the petitioner has not made application in the prescribed format.

Having regard to the facts and circumstances, the Writ Petition is disposed of granting liberty to the petitioner to make necessary application in the prescribed format complying with the

procedural requirements as notified under G.O.Ms.No.55, dated 26.09.2016. As and when such application is made, the competent authority shall dispose of the same in accordance with law, as expeditiously as possible, preferably within a period of four months from the date of receipt of such application. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ____________________________ CHALLA KODANDA RAM, J 14.02.2019 vs
