THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE U. DURGA PRASAD RAO L.A.A.S.Nos.107, 173, 238, 243, 245, 323, 334, 415, 472, 498, 499, 520, 562 and 630 of 2013; 13, 94, 101, 188, 291, 325, 362, 431 and 463 of 2014 COMMON JUDGMENT: (Per Hon'ble Sri Justice Sanjay Kumar) These appeals are posted under the caption 'For Orders' as Sri K. Rathanga Pani Reddy, learned counsel for the respondents in most of these cases, and the learned Government Pleader for Appeals appearing for the State informed this Court that the issue falling for consideration in these cases is squarely covered by the judgment dated 07.04.2016 passed by this Court in L.A.A.S.No.213 of 2013. A copy of the said judgment is placed on record. In five of these matters, despite service of notice, the respondents have not chosen to enter appearance. However, as the matter is squarely covered, we proceed to dispose of the cases finally.
For reasons alike as were mentioned in the aforestated judgment and in terms thereof, these appeals are allowed in part modifying the orders of the Reference Court by substituting the enhancement component in relation to structures/buildings at 80% instead of 90% as ordered by the Reference Court. The rest of the benefits in the orders of the Reference Court shall remain untouched. We also make the orders issued by the State vide G.O.Rt.No.101, Irrigation & CAD (Projects WingL.A.IV-R.R-II) Department, dated 20.02.2006, as part of this common judgment.
Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. In the circumstances, there shall be no order as to costs.
