HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.15535 of 2015 O R D E R:

This writ petition is filed by the petitioner declaring the action of the respondents 2 and 3 in not considering the notice and representations dated 07.09.2016, 09.11.2016, 19.09.2016 and 08.04.2017, as illegal, arbitrary and unconstitutional.

2. The 5th respondent is the father of the petitioner. The petitioner claims a share in the property of her parents. She states that she filed a suit before the Agent to the Government, since the property is situated in a scheduled area and the said suit is not numbered. However, she states that a part of land belonging to the parents of the petitioner, was acquired by the 3rd respondent and compensation is going to be paid to the 5th respondent, ignoring her share. She further states that her counsel issued a notice on 08.04.2017 in that connection and the 3rd respondent without considering the notice/ representations, is going to disburse the amounts to the 5th respondent.

3. In the circumstances, the writ petition is disposed of, directing the 3rd respondent to consider the representations/ notice of the petitioner, also hear the respondents 5 and 6, and pass appropriate orders in accordance with law, with regard to disbursement of the compensation, if any, already not disbursed.

4. The writ petition is, accordingly, disposed of. No order as to costs. Pending miscellaneous petitions, if any, shall stand dismissed in consequence.
