THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.3989 OF 2017 ORDER :

Petitioners filed this writ petition seeking to declare the in action on the part of the 4th respondent-SHO, Nandavaram PS, Kurnool District, in taking action against the 5th respondent by preventing him from interfering with the harvesting work of jowar crop said to have been raised by the petitioners in the land question, as being illegal, arbitrary and for issuance of appropriate consequential directions, in the interest of justice. 2.

Heard the learned counsel for the petitioners and the learned Asst. Government Pleader for Revenue.

A perusal of the averments made in the affidavit filed in support of the petition, goes to show that there are civil disputes between the petitioners and the 5th respondent in respect of the subject land. This Court cannot go into disputed questions of fact and declare the entitlement of the petitioners. Already, this Court disposed of WP No.30897 of 2016 with certain directions and once again this Court cannot give same directions. Petitioners, without any order of the competent civil Court cannot seek Police protection in respect of the subject land from the 4th respondent. I do not see any merit in the writ petition and it is accordingly dismissed. However, it is open for the petitioners to approach the appropriate forum for seeking appropriate relief, if so advised. There shall be

no order as to costs. As a sequel thereto, miscellaneous petitions, if any, shall stand closed.
