HON'BLE DR. JUSTICE B. SIVA SANKARA RAO WRIT PETITION No.2483 of 2018 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner, seeking the following relief: ".......to issue an appropriate writ or order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the 2nd respondent in not regularizing the petitioner plot No.137 in Sy.No.66/s of Rayadurg Navkhalsa Village, Srilingampally Mandal, Ranga Reddy District, under Layout Regularization Scheme as illegal, arbitrary and violation of Articles 14, 21 and 300-A of the Constitution of India and consequently to direct the 2nd respondent to regularize the petitioner plot No.137 in Sy.No.66/s of Rayadurg Navkhalsa Village, Serilingampally Mandal, Ranga Reddy District, under Layout Regularization Scheme and pass such other order or orders as this Hon'ble court may deem fit and proper in the circumstances of the case."

I have heard the submissions of the learned counsel for the petitioner and of Sri Sampath Prabhakar Reddy, learned Standing Counsel for GHMC appearing for respondent Nos.2 to 4. I have perused the material record.

The case of the petitioner is that the petitioner made application, dated 31.05.2013, in respect of subject plot for regularization in accordance with terms of G.O.Ms.No.151, dated 02.11.2015, and that despite such application, the respondent Nos.2 to 4 are not taking any action.

Sri Sampath Prabhakar Reddy, learned Standing Counsel for respondent Nos.2 to 4 states that the petitioner's application would be considered appropriately within a reasonable time and the decision taken would be communicated to the petitioner. 5.

Recording the said submission, the Writ Petition is disposed of directing the 4th respondent to consider the petitioner's application referred to above within a period of eight (8) weeks from the date of receipt of a copy of this order and communicate the decision taken thereon to the petitioner within a week thereafter. Miscellaneous petitions pending, if any, shall stand closed. No costs.
