THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.1475 of 2015 ORDER:

This Criminal Revision Case is filed by the petitioner-accused challenging the order, dated 12.06.2015, passed in Crl.M.P.No.386 of 2015 in CC No.9 of 2006 by the Principal Judge for SPE and ACB cum IV Additional Chief Judge, City Civil Court, Hyderabad. The petitioner is accused in CC No.9 of 2006. He filed an application before the Court below for return of his passport to go to USA for a period of three months to see his son. The Court below has partly allowed the said application, ordering return of passport to the petitioner under proper acknowledgement and dismissed the petition insofar as it relates to permitting the petitioner to go to USA. Challenging the same, the present revision case is filed. Heard and perused the material available on record.

Learned counsel for the petitioner submitted that the Court below has erroneously rejected the request of the petitioner to go to USA and that since the son of the petitioner is staying in USA, he intends to go to USA and that the proceedings in the main case were stayed by this Court and hence, he may be permitted to go to abroad.

The petitioner is directed to file an affidavit before the Court concerned, informing the date on which he is leaving the country and the date on which he will return to India and after return to India, he will surrender the passport before the Court. On filing of such application, the Court concerned is directed to permit the petitioner to go to abroad. With the above directions, the Criminal Revision Case is

disposed of. Miscellaneous petitions, pending if any, shall stand closed.
