THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION Nos.6578 of 2013, 8162 of 2013 and 5792 of 2015 COMMON ORDER:

Criminal Petition Nos.5792/2015, 8162/2013 and 6578/2013 are filed, under Section 482 Cr.P.C, to quash the proceedings in Crime No.24 of 2013 on the file of Women Police Station, Kurnool District, by A1; A2, A3, A6 & A7; and A4, A5 and A8 respectively. The 2nd respondent-de facto complainant and her counsel are present. The petitioners/A1 to A8 and their counsel are also present. Heard both sides and perused the record.

On the report of the 2nd respondent-de facto complainant, the police registered the above crime against the petitioners/A1 to A8 for the offences punishable under Sections 307, 377, 506, 498A read with Section 34 IPC, Section 323 IPC and Sections 4 and 6 of the Dowry Prohibition Act.

It is submitted by both the parties that at the intervention of elders and well wishers, the parties have amicably settled the disputes out of Court concerning the aforesaid crime and that award dated 11.12.2014 was also passed by Lok Adalat Bench at Kurnool in L.A.C. No.1294/2014 in F.C.M.C. No.28/2012 of Family Court, Kurnool recording compromise. Lok Adalat Bench at Kurnool has also passed award on 11.06.2015 in Pre-litigation No.7504/2014 relating to divorce and other aspects.

Criminal M.P. Nos.6615, 6616 and 6622 of 2015 respectively are filed in Criminal Petition Nos.5792/2015, 6578/2013 and 8162/2013 to record the compromise and requested to allow the respective Criminal Petitions by quashing the proceedings in the subject crime.

Having regard to the above submissions and considering the fact

that the parties have amicably settled the disputes between them out of Court and no useful purpose will be served even if the parties are driven to the trial as they compromised, and following the decision reported in Gian Singh v. State of Punjab and another[1], Criminal M.P. Nos.6615, 6616 and 6622 of 2015 are allowed recording the compromise, and consequently, Criminal Petition Nos.5792/2015, 8162/2013 and 6578/2013 are allowed, and the proceedings in Crime No.24 of 2013 on the file of Women Police Station, Kurnool District, against the petitioners/A1 to A8 are hereby quashed. Pending miscellaneous applications, if any, shall stand closed in consequence.
