When this matter is taken up for hearing, it is noticed that the writ petition is dismissed for default against the 2nd respondent vide order dated 18.8.2010. Thereafter, the petitioner has not taken any steps to get the writ petition restored against the 2nd respondent. The petitioner filed this writ petition seeking to direct the 2nd respondent to make payment of the amount covered by E.P. immediately to the petitioner. In the absence of the 2nd respondent, the relief sought by the petitioner cannot be adjudicated on merits. 2.
Accordingly, the Writ Petition is dismissed. No order as to costs. As a sequel, Miscellaneous Petitions, if any pending, shall stand closed.
