HONOURABLE SRI JUSTICE CHALLA KODANDA RAM C.C.No.362 of 2019 ORDER:

The grievance of the petitioner in the Writ Petition is that he made a representation dt.12-04-2016 to the respondents, but they have not considered the said representation. The allegation in the said representation is that the 2nd respondent-Tahsildar colluding with some land grabbers, neglected his duties in protecting and fencing the land admeasuring Ac.0.14 gts which is called as 'kunta' situated in in Sy. No.17 of B.L.Nagar, Boduppal village, Ghatkesar Mandal, Ranga Reddy District and constructions were also made by several people by encroaching the 30' road.

This Court by order dt.05-07-2016 in W.P.No.21824 of 2016, while disposing of the Writ Petition, directed the respondents to consider the representation made by the petitioner and pass appropriate orders thereon, if the same is still pending consideration, in accordance with Law, as early as possible, preferably, within a period of four weeks from the date of receipt of a copy of that order after giving an opportunity of personal hearing to the petitioner. 3.

Alleging willful disobedience of the said order, the present Contempt Case is filed by the petitioner. 4.

In the counter affidavit, filed by the respondent No.2, it is stated that the subject land is situated at Boduppal and is recorded

CKR,J C.C.No.362 of 2019 as 'Poramboke Sarkari'. On the complaint filed by the petitioner, the subject land has been surveyed by the Mandal Surveyor, Medipally for localization of the said land. The Mandal Girdavar, Medipally, inspected the subject land and verified the physical possession of the land with reference to the survey sketch submitted by the Mandal Surveyor, Medipally and reported that the board erected previously is existing in the Government land in Sy. No.17 till today as it is and the total extent of subject land is free from any encroachment.

In the light of the same, the allegation of the petitioner that his representation was not considered cannot be accepted. However, it is open for the petitioner to take appropriate legal proceedings, if he is not satisfied with the action taken by the respondents.

Accordingly, the Contempt Case is closed. No costs. 7.

As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
