HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.324 of 2015 ORDER:
Alleging inaction on the part of respondents 3 and 4 in conducting investigation in Cr.No.382 of 2014, the petitioner filed the present writ petition.
Learned Government Pleader has received instructions, which state that another case in Cr.No.380 of 2014 was registered against the husband of the petitioner, in which the investigation is completed and charge-sheet is being filed.
So far as Cr.No.382 of 2014 is concerned, it is stated to be a cross complaint and the 4th respondent has recorded the statements of eight witnesses and it is stated that on the basis of evidence adduced, since prima facie no case is made out, steps are being taken to refer the case as 'false'.
Since the investigation in Cr.No.382 of 2014 is stated to be almost completed, the 4th respondent is directed to take appropriate steps and file charge-sheet/final report before the jurisdictional court, after duly serving a copy thereof on the petitioner. Accordingly, the writ petition is disposed of. No order as to costs.
The miscellaneous petitions, if any, pending in this writ petition shall stand closed.
