THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.13930 of 2016 ORDER:
The petitioners who are A1 and A2 in Crime No.153 of 2016 of Venkatagiri Police Station, SPSR Nellore District, filed the present application under Section 438 of the Code of the Criminal Procedure (Cr.P.C.), seeking release in the event of their arrest in connection with the above crime, registered for the offences punishable under Sections 409, 420, 468, 471 read with Section 34 of IPC. 2.
The case of the prosecution is that on the basis of a report given by the Commissioner (In-charge), Venkatagiri Municipal Office, Venkatagiri, the above case came to be registered wherein it is alleged that A1 and A2 played fraud in disbursement of pension amount pertaining to few persons/pensioners bearing I.D.Nos.109318657, 109409413, 109113376, 109113399, 1091135092, 109280035, 109318597, 109409413 by putting forged thumb impressions and authenticating the same.

Learned counsel for the petitioner mainly submits that the petitioners are poor people and that great hardship would be caused to their family, if they are arrested. Hence seeks anticipatory bail. 4.
Learned additional public prosecutor opposed the application contending that the allegations made are serious in nature. 5.
A perusal of the averments clearly disclose that the petitioners have authenticated the thumb impressions of the deceased showing as if they are alive.

Having regard to the nature of allegations made, their request cannot be considered. But, however, the petitioners, if so advised, shall surrender before the concerned Court and move an application for grant of bail, in which event the same shall be dealt with in accordance with law at the earliest.
