THE HON'BLE SRI JUSTICE A.V.SESHA SAI CONTEMPT CASE No.1803 of 2015 O R D E R:
This Contempt Case is filed alleging violation of the orders passed by this Court in W.P.No.22012 of 2015, dated 15.07.2015.
2. Heard the learned counsel for the petitioner as also the learned Government Pleader for Revenue for the respondents.
3. By virtue of an order dated 15.07.2015, this Court disposed of the said writ petition and the operative portion at paragraph No.5 of the said order reads as under:
"5. For the aforesaid reasons and having regard to the nature of the controversy, this writ petition is disposed of, directing the respondents herein not to demolish the house of the petitioner herein bearing Plot No.2009/2 situated at Peddamanyam Village and Mandal, Chittoor District, without recourse to law. Miscellaneous Petitions, if any, pending in this Writ Petition, shall stand disposed of. There shall be no order as to costs."
4. A counter affidavit is filed by the sixth respondent/Tahsildar, Peddamandyam Mandal, Chittoor District and paragraph No.7 of the said counter affidavit read as under:
"7. It is further submitted that if really the petitioner's land which was allotted to them on 16.12.1992 is required for road widening, then appropriate proceedings will be initiated as per law. The contention in the petitioner's affidavit that the respondents are trying to demolish the petitioner's house is absolutely incorrect and the same is hereby denied. No action has been taken by this respondent so far subsequent to the orders of this Hon'ble Court as the detailed survey report has been awaited."
5. While referring to the averments in paragraph No. 7 of the counter affidavit, it is submitted by the learned counsel for the petitioner that the Contempt Case may be closed.
6. In view of the above, the Contempt Case is closed by placing on record the averments made at paragraph No.7 of the counter affidavit of the sixth respondent/Tahsildar, Peddamandyam Mandal, Chittoor District. As a sequel, the miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
