THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.27758 of 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a writ of mandamus directing respondent Nos.1 to 5 to re-delegate the powers of Sarpanch to the petitioner.

2. Heard the learned counsel for the petitioner, learned Assistant Government Pleader for Panchayat and Rural Development (Telangana) and learned Standing Counsel for Grama Panchayats.

3. A perusal of the record reveals that the petitioner was elected as Sarpanch of Nagilla Village, Madgul Mandal, Mahabubnagar District in the year 2013. The petitioner was arrested in connection with Crime No.47 of 2016 for the offence under Section 306 IPC and remanded to judicial custody on 25.6.2016.

Pursuant thereto, the second respondent issued proceedings No.A5-1/591/2016, dated 06.7.2016 delegating the powers of Sarpanch of Nagilla Village to the Deputy Sarpanch i.e., the sixth respondent herein.

The petitioner was released on bail. The petitioner was released on bail and thereafter, he made a representation dated 22.7.2016 to the third respondent to redelegate him the powers of Sarpanch. As there was no response from the third respondent, the petitioner has brought the matter to the notice of the second respondent by way of representation dated 27.7.2016.

4. The learned Assistant Government Pleader submitted that the third respondent has issued notice to the petitioner calling for his explanation and, after receipt of the explanation from the petitioner, the third respondent will pass appropriate orders in this matter.

5. Having regard to the facts and circumstances of the case, the second respondent is hereby directed to dispose of the case of the petitioner as expeditiously as possible, preferably within a period of

three weeks from the date of receipt of a copy of this order.

6. With the above direction, the writ petition is disposed of. Miscellaneous petitions if any pending in this writ petition shall stand closed.
