HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL REVISION CASE No.192 of 2017 ORDER :

This revision is filed aggrieved by the order dated 15.9.2016 in Crl.MP.No.517 of 2014 in F.C.O.P.(M.C.) No.315 of 2013 passed by the Judge, Family Court-cum-XII Additional District Judge, Guntur.

Heard before admission and perused the impugned order of the lower Court and the material on record. 3.

Merely because wife is working that is not a ground to avoid maintenance by the husband to the children. Even undisputedly, the husband is able-bodied. Thus he has to work and maintain the minor child of 21⁄2 years. What the learned Judge of the Family Court awarded interim maintenance at Rs.2,000/ - p.m. to the minor child from the date of petition by the impugned order thereby no way requires any interference either on the quantum or from the date of petition, more particularly, from the amended provision in 2001 including to provide interim maintenance from the date of petition.

Accordingly, the Criminal Revision Case is disposed of before admission by confirming the order of lower Court, however by granting time to pay all the arrears in five equal monthly installments and any non-payment of even one monthly installment entitles the revision 3rd respondent/ minor child, represented by the mother to enforce the order for recovery.

Miscellaneous petitions, pending if any, shall stand closed.
