HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 13989 of 2017 Order:

This Writ Petition is filed challenging the action of the respondents 1 to 4 in seeking to evict the petitioner from her land situated in Survey No.1068, admeasuring Ac.1-00 gts., of Janampeta village of Pinapaka Mandal, Bhadradri Kothagudem district, pursuant to an order passed by the second respondent in LTR Case No.38/2016/PNK, dated 18.01.2017. Learned counsel for the petitioner submits that against the said order, the petitioner preferred an appeal to the first respondent along with an application seeking stay on 16.03.2017. Since no regular officer is posted to discharge the duties of the first respondent and the District Collector is incharge of the office of the first respondent, the appeal has not been taken up and there is a threat of eviction of the petitioner pursuant to the order passed by the second respondent.

In the circumstances, this Writ Petition is disposed of directing the first respondent to dispose of the appeal filed by the petitioner as expeditiously as possible and till disposal of the appeal by the first respondent there shall be interim suspension of the proceedings of the second respondent dated 18.01.2017 passed in LTR Case No.38/2016/PNK. It is needless to observe that the first respondent shall pass orders in the appeal preferred by the petitioner after hearing the petitioner and the fifth respondent herein. There shall be no order as to costs. As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
